Erica Berge House of Delegates 35B (“EB HoD 35B”) is committed to safeguarding the privacy of our supporters. This Privacy Policy explains the information we collect from you when you use our website and related digital services (collectively, the “Services”), how we use that information, the limited circumstances in which we share it, and your rights with respect to that information. Please review our Terms of Service, which govern your use of the Services. Any capitalized terms that are not defined in this Privacy Policy shall have the meaning ascribed in the Terms of Service.

We collect information you choose to provide when you interact with the Services, such as when you sign up for emails or text messages, contact the campaign, volunteer, request a yard sign, RSVP to an event, or make a contribution. This information typically includes your name, email address, mailing address, phone number, and any message or comments you send us.

B. Contributions and Payment Information. Contributions made through the Services are processed by a third-party payment processor (for example, WinRed). Your payment information (such as credit or debit card number and expiration date) is submitted directly to that processor and is not stored on our website.

To comply with Maryland election law and the regulations of the Maryland State Board of Elections, we are required to make our best efforts to collect and report the name, mailing address, occupation, and name of employer of individuals whose contributions aggregate $500 or more during an election cycle, as required by Md. Election Law § 13-221(a)(3). Information reported to the Maryland State Board of Elections becomes part of the public record. Generally, contributions are non-refundable. Should you choose to contribute, you will receive an email confirmation of your contribution.

C. Automatically Collected Information. When you visit the Services, we and our service providers may automatically collect a limited amount of technical information to keep the site secure, diagnose problems, and measure aggregate traffic. This may include your Internet protocol (IP) address, browser type and version, operating system, the pages you visit on our site, and the date and time of your visit. We use this information only for the operation, security, and improvement of the Services.

D. Cookies. Our website uses a small number of cookies and similar technologies that are necessary for the site to function (for example, to remember form entries or maintain a session) and for basic, aggregate analytics. We do not use cookies, pixels, or similar technologies for cross-site tracking, targeted advertising, or profiling. You can control cookies through your browser settings; please note that blocking all cookies may impair some features of the Services.

E. Submissions to Public or Social Features. If you post a comment on our website or engage with our pages on social media platforms such as Facebook or Instagram, the content of your post is public and subject to that platform’s own terms and privacy policy. 3. HOW WE USE INFORMATION.

We use the information we collect for the following purposes:

  • Responding to your questions, comments, volunteer sign-ups, and other requests;
  • Sending you campaign updates, event invitations, and other communications you have requested;
  • Processing and acknowledging contributions, and complying with Maryland campaign finance reporting obligations;
  • Operating, maintaining, securing, and improving the Services;
  • Preventing and detecting fraud, abuse, or violations of our Terms of Service;
  • Complying with applicable law, including responding to lawful requests from government authorities.

4. HOW WE SHARE INFORMATION.

We share personal information only in these limited circumstances:

  • Service providers. We share information with vendors who perform services on our behalf, such as our website host, email service provider, text messaging platform, payment processor (e.g., WinRed), and analytics provider. These vendors are permitted to use the information only to provide services to the campaign.
  • Required public disclosures. Contribution information required to be reported under Md. Election Law Title 13 is filed with the Maryland State Board of Elections and becomes part of the public record.
  • Legal process and safety. We may disclose information if we believe in good faith that disclosure is necessary to comply with a law, court order, or other legal process, to enforce our Terms of Service, to protect the rights, property, or safety of the campaign, our supporters, or the public, or to investigate fraud or security incidents.

5. WHAT WE DO NOT DO.

We believe supporters should be able to engage with the campaign without surrendering their privacy. Accordingly:

  • We do not sell your personal information.
  • We do not rent, trade, or exchange our supporter or donor lists with data brokers, commercial list vendors, other campaigns, political committees, or other organizations.
  • We do not use your information for targeted advertising on or off our website.
  • We do not profile visitors using automated decision-making that produces legal or similarly significant effects.
  • We do not collect precise geolocation data, and we do not use Bluetooth beacons or similar proximity tracking.

Text-message consent and opt-in data will not be shared with any third party for that third party’s own marketing purposes.

6. YOUR COMMUNICATION PREFERENCES.

Email. You can unsubscribe from campaign emails at any time by sending a request to [email protected].

Text messages. You can opt out of our mobile messaging program at any time by replying STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL) to +1 (443) 256-6911 or to any text message you receive from us. Message and data rates may apply. Message frequency varies.

Opt-out requests may take a reasonable amount of time to process. Even after you opt out of marketing communications, we may still send transactional messages necessary to administer your account or acknowledge a contribution.

Cookies and tracking signals. You can control cookies through your browser settings. We honor recognized Universal Opt-Out Mechanisms, including the Global Privacy Control (GPC), where required by applicable law. Because we do not engage in targeted advertising or the sale of personal information, most opt-out preference signals have no practical effect on our processing.

7. CHILDREN’S PRIVACY.

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (“COPPA”). If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete it. Consistent with the Maryland Online Data Privacy Act, we will not process the personal data of a known Maryland consumer under the age of 18 for purposes of targeted advertising, nor sell the personal data of a known Maryland consumer under the age of 18, without the consent required by law. 8. SECURITY AND BREACH NOTIFICATION.

We maintain reasonable physical, electronic, and procedural safeguards designed to protect the information we collect, consistent with the Maryland Personal Information Protection Act (Md. Commercial Law § 14-3501 et seq.). In the event of a security breach involving unauthorized acquisition of unencrypted personal information, we will investigate in good faith and, where required, provide notice to affected individuals and the Office of the Maryland Attorney General in accordance with applicable law. No method of transmission or storage on the Internet is perfectly secure, and we cannot guarantee absolute security.

9. YOUR MARYLAND PRIVACY RIGHTS.

If you are a resident of the State of Maryland, you may have certain rights under the Maryland Online Data Privacy Act (“MODPA”) with respect to personal data we maintain about you. These may include the right to: (i) confirm whether we are processing your personal data and access that data; (ii) correct inaccuracies in your personal data; (iii) delete personal data we have collected from you, subject to exceptions permitted by law; (iv) obtain a copy of your personal data in a portable format; and (v) opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of solely automated decisions producing legal or similarly significant effects. As described in Section 5, we do not engage in the sale of personal data, targeted advertising, or such profiling.

Information we are required to report to the Maryland State Board of Elections under Md. Election Law Title 13 is a matter of public record and is not subject to deletion to the extent retention is required by law.

We will respond within forty-five (45) days of receipt, subject to any extension permitted by law. If we decline to act on your request, you have the right to appeal our decision by replying to our response or contacting us at the address in Section 13. 10. YOUR CALIFORNIA PRIVACY RIGHTS.

As described in Section 5, we do not sell personal information and do not share personal information with third parties for their own direct marketing purposes.

The Services may contain links to websites and platforms operated by third parties, including payment processors and social media platforms. We are not responsible for the privacy practices of those third parties. When you follow such a link, we encourage you to review the privacy policy of the third party before providing any information.

Accuracy. It is your responsibility to give us current, complete, and accurate information. We will reject and delete any entry that we believe in good faith to be false or fraudulent.

Federal law generally prohibits contributions to candidates from foreign nationals; by contributing, you affirm that you are a U.S. citizen or lawfully admitted permanent resident.

Policy changes. We may modify this Privacy Policy from time to time. Material changes will be noted on this page along with an updated “Last modified” date. Your continued use of the Services after a revision signifies your acceptance of the revised Privacy Policy.

Sole statement. This document is the sole statement of the Services’ Privacy Policy, and no summary, restatement, or other version thereof, in any form, including any machine-generated version, is valid.
